View Buildings Terms & Conditions
Use of the View Buildings website is subject to the following terms. By using the View
Buildings website you accept these terms and agree to be bound by them. You should also
read the Privacy Policy.
A. View Buildings Usage
1. The following terms relate to your use of the website and to any subsequent use you
make of the information and material you obtain from it.
2. The website is provided on an "as is" basis. No warranties are given with
respect to any part of this website or the completeness or accuracy of the information it
contains.
3. The Digital Atlas of England and its employees shall not be liable for any loss or
damages or expenses of any kind including without limitation compensatory, direct,
indirect or consequential damages, loss of data, income or profit, loss of or damage to
property or claims by third parties howsoever arising in connection with the copying or
use of any information or material contained in or referred to on this website or
otherwise from the use of this website.
4. The View Buildings website, database, and the information and photographs it contains
are protected by copyright and other intellectual property rights. Users of this website
may access and download the copyright material provided that it is for research or private
study only. Any other use of the material, including republishing the information or
photographs, requires formal permission from the Digital Atlas of England.
5. When using the website you should note that for security reasons information is logged
regarding access to pages and images on the site.
6. You may not use the information or photographs in any way which is defamatory,
unlawful, immoral, fraudulent, or in a manner which may be used in any way to the
detriment of any of the documented properties or their occupants.
7. The Digital Atlas of England will always give a minimum of several days notice should
the site need to be taken down for scheduled repair or maintainance. However, due to the
nature of the Internet and networks there may be times when the site is not accessible
because of things beyond our control. The Digital Atlas of England accepts no
responsibility for non-scheduled inaccessibility, poor response times, or any other
situations which may affect the normal use of the site.
B. Payment and refunds
1. Payment must be made through the PayPal mechanism on the View Buildings website and
are governed by the rules and regulations of PayPal. Invoices and receipts are sent via
PayPal.
2. Access to the information and pictures for the county The Soke of Peterborough
is free. Access to the information and pictures for all other counties require payment as
listed on the Subscription section of the web site.
3. You must be eighteen (18) or over to subscribe to the non-free material on this
website. The View Buildings service is for the personal use of individual subscribers only
and may not be used in connection with any commercial endeavors.
4. In the event that all your subscribed counties have expired and you have not logged
into the site for more than one (1) year after the last login, we reserve the right to
delete your account. In this case you will be required to re-register if you subsequently
wish to use the site again.
5. Under the United Kingdom Consumer Protection (Distance Selling) Regulations 2000,
you can postpone commencement of a subscribed county until the seven working day
cooling-off period has expired. However, if you choose to start accessing the information
and pictures for the subscribed county, you are electing to commence using that service
immediately and you thereby waive any right to cancel the subscribed county under these
regulations.
6. You may terminate your membership at any time, for any reason, effective upon
receipt by us of your written or email notice of termination. You may contact us by email:
info@digiatlas.net.
7. We may immediately terminate your membership and your access to the View Buildings
website because you have breached this Agreement and will send you notice of termination
at the email address you provide in your registration or such other email address as you
may later provide to us. If we terminate your membership in this service because you have
breached the Agreement, we will refund any pre-payments made by you less reasonable costs
and losses we have incurred. We can terminate this contract at any time by giving you
reasonable advance written notice.
C. Your obligations and liabilities
1. As part of the registration process, you will select an email address and a
password. You must not disclose this to anyone else.
2. You must notify us as soon as possible, by emailing info@digiatlas.net, if you know
of, or suspect, any unauthorised use of your account or any breach of security (including
loss, theft, or unauthorised disclosure of your user name or password).
3. We will never ask you to reveal your password to anyone.
4. We will not pass on your email address to any third party. Email addresses will only be
used for registration, occasional announcements which may effect your use of the service,
and logging-in purposes.
D. Law
1. These terms, your Agreement with us, your use of the View Buildings website, and any
issue arising in connection with any of these, are all subject to English law and the
courts of England and Wales have exclusive jurisdiction in respect of any dispute arising
in connection with any of these.
E. Changes to these terms
1. The Digital Atlas of England reserves the right to change or amend these Terms and
Conditions without prior notice.
